This Privacy Policy (“Privacy Policy”) describes how Artisans Co-op collects, uses, and shares your Personal Information, as well as an explanation of the data rights you may have in that Personal Information. This Privacy Policy applies to all Artisans Co-op users, including unregistered visitors, registered users, artisan vendors, and cooperative member users (collectively, “Users”, “you”, or “your”). For purposes of this policy, “Services” collectively means all Artisans Co-op services, including our websites (including https://artisans.coop/ and any of its subdomains, the “Website”), web applications we use for marketplace, community, and cooperative purposes (“Artisans Co-op Apps”), mobile applications (“Mobile Apps”), and related services. This Privacy Policy is not intended to override the terms of any contract you have with us, nor any rights you may have under other applicable data privacy laws.

Prior to accessing or using our Services, please read this policy and make sure you fully understand our practices in relation to your Personal Information. By using and accessing any of the Services, you agree to the collection, use, and disclosure of your information as described in this Privacy Policy. If you do not agree to this Privacy Policy, please immediately discontinue all use of any of our Services. 

2. What Personal Information Do We Collect?

2.1. User Information:

To provide you the Services, we must collect personal information relating to an identified or identifiable natural person (“Personal Information”). We collect Personal Information you provide us, from your use of the Services, and from other sources. Here are the types of Personal Information we collect about you:

  1. Information you provide us. When you register for our Services, sign up for any Artisans Co-op events, subscribe to our blog(s) or newsletter(s), join our cooperative business, register shopping accounts or selling accounts, apply for artisan handmade verification, use any of our Services, and/or when you contact us directly by any communication channel (e.g., Artisans Co-op’s support tickets, emails, and online forms), you may provide us Personal Information, such as:
    1. Basic contact details: name, address, email address, phone number, business contact information
    2. Order information including your name, billing address, shipping address, payment confirmation, email address, phone number.
    3. Account information including your username, password, security questions.
    4. Shopping information including the items you view, put in your cart or add to your wishlist.
    5. Customer support information including the information you choose to include in communications with us, for example, when sending a message through the Services. 
    6. Payment information for Users that provide such information directly for Services, such as phone orders, check payments, donations, or cooperative memberships), 
    7. Personal and/or business information, including such things as signatures, demographic information, information contained in scanned identification documents for tax purposes, such as tax identification numbers or official company registration documents 

You may elect not to provide this information, but doing so may prevent you from using or accessing these Services.

  1. Information we collect when you use the Services. When you visit, download, and/or use any of our Services, we may collect aggregated information about how you access and use our Services ("Usage Data"). To do this, we may use cookies, pixels, and similar technologies ("Cookies"). Usage Data may include Personal Information, such as Visitors’ and Users’ browsing and ‘click-stream’ activity on the Services, session heatmaps and scrolls, non-identifying Personal Information regarding the Visitor’s or User’s device, operating system, internet browser, screen resolution, language and keyboard settings, internet service provider, referring/exit pages, date/time stamps, etc.
  2. Information we collect from other sources. We may receive Personal Information about you from third-party sources, such as: 
    1. Companies who support our Site and Services, such as Shopify.
    2. Security providers (for example: fraud detection and prevention providers for example to help us screen out Users associated with fraud)
    3. Social media platforms, when you log-in or sign-up using your social media account, we may receive Personal Information from that service (e.g., your username, basic profile Personal Information) 
    4. Our payment processors, who collect payment information (e.g., bank account, credit or debit card information, billing address) to process your payment in order to fulfill your orders and provide you with products or services you have requested, in order to perform our contract with you.
    5. Companies that help us to improve our service offering, such as advertising and marketing partners to monitor, manage, and measure our ad campaigns.
    6. When you visit our Website, open or click on emails we send you, or interact with our Services or advertisements, we, or third parties we work with, may automatically collect certain information using online tracking technologies such as pixels, web beacons, software developer kits, third-party libraries, and cookies. 

Any information we obtain from third parties will be treated in accordance with this Privacy Policy. We are not responsible or liable for the accuracy of the information provided to us by third parties and are not responsible for any third party's policies or practices. 

2.2. Users-of-Users’ Personal Information

We may also collect Personal Information pertaining to visitors and users of our User’s websites or services (“Users-of-Users”), solely for and on our Users’ behalf (as further described in Section ‎6 below).

3. Why Do We Collect Such Personal Information?

We use your Personal Information for the following purposes:

  • Providing Products and Services. We use your personal information to provide you with the Services in order to perform our contract with you, including to process your payments, fulfill your orders, to send notifications to you related to your account, purchases, returns, exchanges or other transactions, to create, maintain and otherwise manage your account, to arrange for shipping, facilitate any returns and exchanges, and to enable you to post reviews.
  • Marketing and Advertising. We use your personal information for marketing and promotional purposes, such as to send marketing, advertising, and promotional communications by email, text message or postal mail, and to show you advertisements for products or services. This may include using your personal information to better tailor the Services and advertising on our Site and other websites.
  • Security and Fraud Prevention. We use your personal information to detect, investigate, or take action regarding possible fraudulent, illegal or malicious activity. If you choose to use the Services and register an account, you are responsible for keeping your account credentials safe. We highly recommend that you do not share your username, password, or other access details with anyone else. If you believe your account has been compromised, please contact us immediately.
  • Communicating with You. We use your personal information to provide you with customer support and improve our Services. This is in our legitimate interests in order to be responsive to you, to provide effective services to you, and to maintain our business relationship with you. 

We may use techniques like “machine learning” (European law refers to this as “automated decision-making”) to help us improve our services. When we use machine learning, we either: (i) still have a human being involved in the process (and so are not fully automated); or (ii) use machine learning in ways that don’t have significant privacy implications. We may also use machine learning to help us monitor, identify, and suspend accounts sending spam, or engaging in other abusive or fraudulent activity.  

We use your Personal Information for the purposes set out in this section where:

  1. Our use of your Personal Information is necessary to perform a contract or to take steps to enter into a contract with you (e.g. to join as cooperative members, to provide you with a marketplace shop, to provide you with our customer assistance and technical support);
  2. Our use of your Personal Information is necessary to comply with a relevant legal or regulatory obligation that we have; or
  3. Our use of your Personal Information is necessary to support legitimate interests and business purposes (for example, to maintain and improve our Services and the effectiveness of Artisans Co-op by identifying technical issues), provided it is conducted in a way that is proportionate and that respects your privacy rights.

4. How We Disclose Your Personal Information

We may disclose your Personal Information with service providers and others (or otherwise allow them access to it). 

We do not use or disclose sensitive personal information for the purposes of inferring characteristics about you.

4.1 User Generated Content

The Services may enable you to post product reviews and other user-generated content. If you choose to submit user generated content to any public area of the Services, this content will be public and accessible by anyone.

We do not control who will have access to the information that you choose to make available to others, and cannot ensure that parties who have access to such information will respect your privacy or keep it secure. We are not responsible for the privacy or security of any information that you make publicly available, or for the accuracy, use or misuse of any information that you disclose or receive from third parties.

4.2 Third-Party Services

Artisans Co-op has partnered with a number of selected service providers, whose services and solutions complement, facilitate, and enhance our own. These include hosting and server co-location services, communications and content delivery networks (CDNs), data and cyber security services, billing and payment processing services, domain name registrars, fraud detection and prevention services, web analytics, e-mail distribution and monitoring services, session recording and remote access services, performance measurement, data optimization and marketing services, content providers, and our legal and financial advisors (collectively, “Third-Party Services”). 

Artisans Co-op may share the following categories of Personal Information with Third-Party Services for a business purpose:

  • identifiers, including name, alias, postal address, unique personal identifier, online identifier, internet protocol address, email address, account name, or other similar identifiers.
  • commercial Personal Information, for example Personal Information regarding products or services purchased, obtained, or considered.

4.3 Law Enforcement, Legal Requests, and Duties 

We may disclose the Personal Information of our Users and Users-of-Users with various third parties, including certain service providers and law enforcement officials, solely in accordance with this policy, pursuant to a legal request, such as a subpoena, legal proceedings, search warrant or court order, or in compliance with applicable laws, if we have a good faith belief that the law requires us to do so, with or without notice to you.

4.4 Protecting Rights and Safety 

Artisans Co-op may share any categories of your Personal Information described in this Privacy Policy if we believe in good faith that this will help protect the rights, property or personal safety of Artisans Co-op, any of our Users, any Users-of-Users, or any member of the general public, with or without notice to you.

4.5 In Connection with a Change in Corporate Control

Should Artisans Co-op or any of its affiliates undergo any change in control, including by means of subsidiary or affiliated company creations, merger, acquisition, or purchase of substantially all of its assets, your Personal Information may be disclosed to the other parties involved in the transaction.

4.6 Upon Your Further Direction 

The Services enable you, through different techniques, to engage and procure various Third-Party Services, products and tools for enhancing your web or mobile sites, including, without limitation, third party designers who may assist you with your website, etc. (collectively, “Third-Party Services”). If you choose to engage with such Third-Party Services, they may have access to and process Personal Information of your Users-of-Users collected through your web or mobile sites. For example:

  1. a) Framed Pages: our Services may enable you to integrate Third-Party Services directly into your web or mobile sites, such as via page framing techniques to serve content to or from Third-Party Services or other parties (“Frames”). In these circumstances, the Third-Party Services may collect Personal Information from your Users-of-Users.
  1. b) Social Media Features: Our Services may enable you to integrate certain Social Media features, widgets, and single sign on features, such as “Facebook Connect,” or “Google Sign-in” (“Social Media Features”) into your web or mobile sites. These Social Media Features may collect certain Personal Information from your Users-of-Users such as identifiers, including name, alias, unique personal identifier, online identifier, internet protocol address, email address, or other similar identifiers. Social Media Features are hosted either by a third party or directly on our Services.

 

Please note that Artisans Co-op merely acts as an intermediary platform allowing you to procure the services of such Third-Party Services (including, but not limited to, Third Party Developers, Third Party Apps and Social Media Features) with which you are interacting directly, and at your discretion. In this respect, Artisans Co-op acts as a service provider to you, disclosing information to the Third-Party Services on your behalf. Artisans Co-op will share your Users-of-Users’ Personal Information with Third Parties Services only upon your direction or with your permission and is not, and shall not be, in any way responsible for such Third-Party Services processing of such Personal Information, or liable with respect thereto.

 

Artisans Co-op does not control and is not responsible for the actions or policies of any Third-Party Service, and your use of any Third-Party Service is at your own risk. We encourage you to review any privacy policy accompanying a Third-Party Service and ask such Third-Party Service for any clarifications you may need before deciding to install and/or use their services.

5. Where We Store / Process Your Personal Information

By using the Services, you acknowledge that Artisans Co-op will use your information in the United States and any other country where our affiliate companies may operate. Please be aware that the privacy laws and standards in certain countries, including the rights of authorities to access your personal information, may differ from those that apply in the country in which you reside. To the extent that Artisans Co-op is deemed to transfer personal information outside of the European Economic Area (“EEA”), we rely separately, alternatively, and independently on the following legal bases to transfer your information:

Adequacy Decisions. Where available, we rely on decisions of the European Commission, known as “adequacy decisions,” recognising that certain countries offer a level of protection of personal data that is essentially equivalent to the EEA. A list of adequacy decisions is available here via the European Commission website.

Standard Contractual Clauses. Otherwise, we primarily rely on the European Commission’s Standard Contractual Clauses for the international and onward transfer of personal data outside of the EEA to third countries, including, for example, to the United States and India.

Necessary for the Performance of the Contract Between Artisans Co-op and Its Users. You can choose whether or not to use the Services. As we operate in countries worldwide and use technical infrastructure in the US to deliver the Services to you, in accordance with the contract between us (our Terms of Service), we transfer your personal information to the US and to other jurisdictions as necessary to provide the Services. Simply put, we can’t provide you with the Services and perform our contract with you without moving your personal information outside of your home country, including the UK or EEA.

6. Artisan Responsibilities

If you are an Artisan selling on our Services, you may receive certain personal information and will have legal obligations in respect of this information. Your privacy responsibilities, including when you act as an independent data controller (someone who decides what personal data to collect and the purpose you use the data for) are laid out in our Terms of Service.

7. Cookies and Other Third Party Technologies

We and our Third-Party Service Providers use cookies and other similar technologies (“Cookies”) in order for us to provide our Service and ensure that it performs properly, to analyze our performance and marketing activities, and to personalize your experience. For specific information about the Cookies that we use related to powering our store with Shopify, see https://www.shopify.com/legal/cookies. We may also permit third parties and services providers to use Cookies on our Site to better tailor the services, products, and advertising on our Site and other websites.

Please note that we do not change our practices in response to a “Do Not Track” signal in the HTTP header from a browser or mobile application. Most browsers automatically accept Cookies by default, but you can choose to set your browser to remove or reject Cookies through your browser controls. Please keep in mind that removing or blocking Cookies can negatively impact your user experience and may cause some of the Services, including certain features and general functionality, to work incorrectly or no longer be available. Additionally, blocking Cookies may not completely prevent how we share information with third parties such as our advertising partners.

8. Your Rights and Choices

Depending on where you live, you may have some or all of the rights listed below in relation to your personal information. However, these rights are not absolute, may apply only in certain circumstances and, in certain cases, we may decline your request as permitted by law.

  • Right to Access / Know. You may have a right to request access to personal information that we hold about you, including details relating to the ways in which we use and disclose your information.
  • Right to Delete. You may have a right to request that we delete personal information we maintain about you.
  • Right to Correct. You may have a right to request that we correct inaccurate personal information we maintain about you.
  • Right of Portability. You may have a right to receive a copy of the personal information we hold about you and to request that we transfer it to a third party, in certain circumstances and with certain exceptions.

Right to Opt out of Sale or Sharing or Targeted Advertising. You may have a right to direct us not to "sell" or "share" your personal information or to opt out of the processing of your personal information for purposes considered to be "targeted advertising," as defined in applicable privacy laws. Please note that if you visit our Site with the Global Privacy Control opt-out preference signal enabled, depending on where you are, we will automatically treat this as a request to opt-out of the "sale" or "sharing" of information for the device and browser that you use to visit the Site. 

Right to Limit and/or Opt out of Use and Disclosure of Sensitive Personal Information. You may have a right to direct us to limit our use and/or disclosure of sensitive personal information to only what is necessary to perform the Services or provide the goods reasonably expected by an average individual.

  • Restriction of Processing: You may have a right to ask us to stop or restrict our processing of personal information.
  • Withdrawal of Consent: Where we rely on consent to process your personal information, you may have a right to withdraw this consent.
  • Appeal: You may have a right to appeal our decision if we decline to process your request. You can do so by replying directly to our denial.
  • Managing Communication Preferences: We may send you promotional emails, and you may opt out of receiving these at any time by using the unsubscribe option displayed in our emails to you. If you opt out, we may still send you non-promotional emails, such as those about your account or orders that you have made.

You may exercise any of these rights where indicated on our Site or by contacting us using the contact details provided below.

We will not discriminate against you for exercising any of these rights. We may need to collect information from you to verify your identity, such as your email address or account information, before providing a substantive response to the request. In accordance with applicable laws, you may designate an authorized agent to make requests on your behalf to exercise your rights. Before accepting such a request from an agent, we will require that the agent provide proof you have authorized them to act on your behalf, and we may need you to verify your identity directly with us. We will respond to your request in a timely manner as required under applicable law.

9. Data Security and Retention

Please be aware that no security measures are perfect or impenetrable, and we cannot guarantee “perfect security.” In addition, any information you send to us may not be secure while in transit. We recommend that you do not use insecure channels to communicate sensitive or confidential information to us.

We encourage you to set strong passwords for your User Account and User Website, and avoid providing us or anyone with any sensitive Personal Information if you believe its disclosure could cause you substantial or irreparable harm.

Furthermore, because certain areas on our Services are less secure than others (for example, if you browse to a non-SSL page), and since e-mail and instant messaging are not recognized as secure forms of communications, we request and encourage you not to share any Personal Information on any of these areas or via any of these methods.

How long we retain your personal information depends on different factors, such as whether we need the information to maintain your account, to provide the Services, comply with legal obligations, resolve disputes or enforce other applicable contracts and policies.

10. Third Party Websites and Links

Our Services may contain links to other websites or services. We are not responsible for such websites’ or services’ privacy practices. We encourage you to be aware when you leave our Services and to read the privacy statements of each and every website and service you visit before providing your Personal Information. Information you provide on public or semi-public venues, including information you share on third-party social networking platforms, may also be viewable by other users of the Services and/or users of those third-party platforms without limitation as to its use by us or by a third party. Our inclusion of such links does not, by itself, imply any endorsement of the content on such platforms or of their owners or operators, except as disclosed on the Services.This Privacy Policy does not apply to such linked third-party websites and services.

11. Children’s Data

The Services are not intended to be used by children, and we do not knowingly collect any personal information about children. If you are the parent or guardian of a child who has provided us with their personal information, you may contact us using the contact details set out below to request that it be deleted.

As of the Effective Date of this Privacy Policy, we do not have actual knowledge that we “share” or “sell” (as those terms are defined in applicable law) personal information of individuals under 16 years of age.

12. Updates to This Policy 

We may amend or update this Privacy Policy from time to time. If we believe that the changes are material, we’ll let you know by posting the changes through the Services and sending you an email or message about the changes. We encourage you to check back regularly and review any updates.

If you have complaints about how we process your Personal Information, please contact us using the contact details provided below. If you are not satisfied with our response to your complaint, depending on where you live you may have a right to appeal our decision by contacting us using the contact details set out below, or lodge your complaint with your local data protection authority.
